When selling, there are mandatory certificates you must provide: the post-intervention file, the energy performance certificate (EPC), the soil certificate, the urban planning certificate, the electrical installation inspection certificate, the cadastral documents, the asbestos certificate, and information on flood risk. When a seller accepts your offer, Clintimmo puts the property ‘in option.’ During the period that a property is in option, the remaining sale documents, such as the preliminary agreement, are prepared. Once the preliminary agreement is signed and any suspensive conditions are met, the property is officially sold!
Since January 1, 2023, in Flanders, it is mandatory to indicate the flood risk of a property using a P-score for the plot and a G-score for the building when selling or renting (for more than 9 years).
Why the difference? A plot may be at risk of flooding due to a stream at the edge of the plot, but this doesn’t necessarily mean the building is in a flood-prone area.
These scores are divided into four classes, from A (lowest risk) to D (medium risk).
In Flanders, from 2023, there is a renovation obligation for homes and apartments. If you buy a property with an EPC label E or F, you must upgrade the label to D (or better) within five years through renovation work.
Once the seller confirms acceptance of your offer, it is binding. If the seller rejects the offer or makes a counteroffer, the original offer expires.
If you want to make an offer, be sure to keep these tips in mind:
- Make sure you are well-informed: visit your bank beforehand and obtain all necessary information about the property.
- Clearly state an end date and any conditions in your offer.

Here’s a rundown of the additional costs:
- Registration or sales rights: This is the tax you pay for every property purchase. In Flanders, different rates apply under the pre-emption right. The main ones are:
- Reduced rate: 3% if you are buying your only family home. Note that there are conditions to qualify for this reduced rate.
- General rate: 12% for other properties, such as second homes and building plots.

- VAT instead of registration rights: If you buy a new construction home, you will pay VAT on the construction value and possibly also on the land value. The VAT rate is 21%.

- Mortgage loan costs: If you take out a loan to buy your property, you’ll pay file fees to your bank. These rates vary by bank.
